if I have 2 on same node would I get wallerdgarden on 1 or would it just constantly reset until 1 is unplugged also would 1 get banned?

As i see, if you have 2 modems with the same mac and cert and in the same node, they will continuosly up and restart. You will get the wallgarden when your modem does not provisioned.

That depends entirely upon your ISP and how they choose to deal with rogue network elements. Best defense against being banned is to never clone your sub. Every time it registers on a CMTS it leaves a log, get too many in different areas and it will surely bite you in the ass.
